Dua Zehra d/o Syed Mehdi Ali Kazmi v/s Zaheer – a case of child trafficking

Dua Zehra’s parents reached our organization for legal assistance through the referral of Hon’ble Ms. Shehla Raza (Minister, Women Development Department, Government of Sindh). He stated that his daughter Mst. Dua Zehra is a 13 y/o and 11 months minor who got abducted by Zaheer Ahmed and other gangs who abduct young girls into human trafficking. The gang is based in Lahore. The father of Mst. Dua Zehra lodged FIR no. 159/2022 at Police Station Alfalah U/S 364-A and 3 (1) of Prevention of Trafficking in Person Act, 2018. Then, on behalf of Mr. Mehdi Kazmi, Dua’s father we filed constitutional petition D-2787/2022 for missing persons. After several directions given by the Hon’ble Justice to produce minor before the court. Finally, we were successful in finding out Dua Zehra’s whereabouts and recovering her. She was recovered on dated: 8.06.2022. Along with our organization, he found out that his daughter was a victim of child trafficking. Hon’ble Justice after recording Dua Zehra’s statement, matter referred to trial court. The trial court shall decide in the light of her statement. Furthermore, I.O. submitted final challan on the basis of Dua’s statement. Mr. Mehdi thanked our organization for helping him recover his daughter.

Mst. Ume Hani d/o Nasir – a case of kidnapping in Hyderabad

Women Development Department, Government of Sindh referred case of Ume-Hani to us on 1st July 2022. In this case, the father/complainant shared the facts of the case that his daughter Mst. Ume Hani was abducted by a group of unknown persons. The FIR no. 42/2022 U/S 365-B, 34 PPC was also lodged at P.S. Pinyari, Hyderabad. Since the matter required prompt action, therefore, we assigned the case to concerned advocate, Ms. Saiqa Ansari from our Hyderabad Litigation team without any delay. Ms. Saiqa Ansari then proceeded the case and conducted frequent meetings with Mr. Nasir and Women Development Department personnel. The case of Mst. Ume Hani d/o Nasir was presented before the learned Magistrate was already disposed of the matter U/S C-class report which was submitted by the investigation officer in the light of minor’s statement. Her statement was recorded by I.O. under direction of Honorable High Court. However, our expert lawyering in Gender-based violence understood the previous discrepancies caused in the case. Our advocate then filed a missing petition in High Court, Hyderabad and she also filed a direct complaint before district and sessions judge. Same cognizance was taken by the judge and directed to the learned magistrate and conduct inquiry within 15 days and submitted report before concerned court.

Bakhtawar Fatima – a case of kidnapping in Karachi

We received the case of Bakhtawar Fatima from Honorable Ms. Shehla Raza (Provincial Minister of Sindh, Women Development Department). She is a 14 year old who got abducted by an unknown group. The trial court and the I.O. of Clifton rejected the investigation of this case. According to her parents, Bakhtawar was kidnapped on March 16th, 2022 by Shahzad Ali Khaskeli, Farida Khaskeli and Ayaz Khaskeli. Our organization continues to strive for legal justice and therefore, we extended our complete support with Bakhtawar Fatima. On the behalf of our organization, Mr. Altaf Khoso (PLUS Chairman) represented Ms. Bakhtawar in court. Through our legal representation, we stated that a proper investigation was not conducted and her case referred as “C” class. Furthermore, records reveals that minor’s statement was recorded in High Court of Karachi and Hyderabad. In the light of statement, investigation officer disposed of the matter. Earlier report of IO of “C” class is reject and directed to Investigation officer conduct fair investigation and submit report to within ten days. According to Sindh Child Marriage Restraint Act 2018, her real age is less than 18 years old. Eventually, as per our legal representation, I.O. was directed to submit the new fresh report. Within the period of 10 days, Bakhtawar Fatima was released and was returned to her parents. Her parents thanked our organization for the legal assistance

Mst. Noora d/o Nasir – a case of legal protection in Sukkur

On dated: 30.8.22; learned advocate of Pakistan Legal United Society, Ms. Iqra Khan received the case of Mst. Nooran in Sukkur. She stated that her along with her daughter Zoya w/o Deefar Hussain were sent to Darul Amaan for protection and safety. Their life was in serious danger due to immoral behavior of Nooran’s brother-in-laws. Her husband passed away a few years ago and since then her in-laws has only maltreated her and the daughter. They also received death threats at the hands of her in-laws. Therefore, lady Mst. Nooran and her daughter, Mst. Zoya had to leave their in-laws home. Therefore, our advocate, Ms. Iqra Khan took immediate actions to provide legal protection to both the women. With the due efforts of our advocate, Mst. Nooran was provided legal protection from her brother-in-laws within the matter of a single day. On dated: 1.8.2022; the legal protection to both women were granted and they were allowed to reside in Darul Amaan as much as they want. Mst. Nooran and her daughter thanked PLUS Legal Aid Sukkur for the prompt actions.
